PLEASE READ THESE TERMS & CONDITIONS (“T&C”) CAREFULLY.
Your use of this site constitutes your irrevocable, unconditional, and unlimited acceptance of all provisions herein.

Welcome to www.vigohiring.com (“Site”), operated by Vigo Hiring, Gurugram, Haryana (“Vigo Hiring,” “we,” “us,” “our”). By accessing or using this Site in any manner, you (“you,” “User”) agree to be legally bound by these T&C and our Privacy Policy (incorporated herein by reference). If you do not accept these T&C in full, cease use immediately.


1. Acceptance & Unilateral Amendment

1.1 Absolute Acceptance:
Your mere access—whether intentional or inadvertent—to any part of the Site constitutes your irrevocable agreement to every clause herein.

1.2 Unconditional Amendment:
We may, at our sole discretion and without notice, modify, suspend, or terminate any aspect of the Site or these T&C at any time. Continued use following any change is your binding acceptance of the revised T&C. It is your sole responsibility to review the T&C prior to each use.


2. Strict “As-Is” Disclaimer & No Reliance

2.1 No Warranties:
The Site and all content, information, services, functionality, and any future features are provided strictly “AS-IS” and “AS-AVAILABLE,” without any warranties, express or implied (including but not limited to merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, security, or timeliness).

2.2 Rare & Unforeseen Events:
We disclaim any liability for failures resulting from force majeure events, including acts of God, war, terrorism, civil unrest, cyber-attacks, government action, network failures, third-party service interruptions, or any other event beyond our reasonable control.

2.3 No Reliance:
You agree that you do not rely on any representation, statement, or warranty—whether oral, written, or implied—other than those explicitly set forth herein. Any advice or information obtained via the Site is at your own risk.


3. Extreme Limitation of Liability

3.1 Liability Cap:
To the maximum extent permitted by law, the aggregate liability of Vigo Hiring and its affiliates, officers, directors, employees, agents, successors, and assigns (“Vigo Hiring Parties”) arising out of or relating to these T&C or your use of the Site shall not exceed ₹1,000 (one thousand rupees) or the amount you paid us in the preceding six (6) months, whichever is lower.

3.2 No Damages:
Under no circumstance shall any Vigo Hiring Party be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages—including but not limited to loss of profits, revenue, data, goodwill, or business interruption—arising from or related to your use or inability to use the Site, even if advised of the possibility of such damages.

3.3 Absolute Waiver of Remedies:
You hereby waive any right to seek equitable relief (including injunctions), statutory damages, punitive damages, or any remedy not expressly provided for in these T&C.


4. Mandatory, Unconditional Indemnification

You shall defend, indemnify, and hold harmless the Vigo Hiring Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and expert fees) arising out of or relating to:

  • Your use or misuse of the Site;
  • Any breach by you of these T&C;
  • Your violation of applicable law or third-party rights;
  • Content you submit, post, or transmit;
  • Your negligence or willful misconduct.

This obligation is immediate upon demand and survives termination.


5. Intellectual Property & Highly Restricted License

5.1 Ownership:
All content and intellectual property on the Site (text, graphics, logos, software, data, URLs, domain names) are owned or licensed by Vigo Hiring and protected by Indian and international intellectual property laws.

5.2 Narrow License:
You are granted a revocable, non-exclusive, non-transferable license to view Site content solely for personal or internal business use. Any other use—copying, distribution, modification, reverse-engineering, data-mining, scraping, or commercial exploitation—is strictly prohibited and constitutes immediate breach.


6. Prohibited Conduct

You agree not to, nor assist any third party to:

  • Use the Site for unlawful, harassing, defamatory, obscene, or malicious purposes;
  • Impersonate any person or entity or misrepresent your affiliation;
  • Disrupt or interfere with Site operations or security;
  • Transmit viruses, malware, or other harmful code;
  • Scrape, spider, or use automated means without our express written consent;
  • Harvest or collect personal data about other users;
  • Circumvent any technological measures to restrict access.

Violation permits immediate termination of your access and pursuit of all legal remedies.


7. Third-Party Links & Disclaimers

The Site may link to or embed third-party content. We do not endorse and are not liable for any content, products, or services on those sites. Your use of third-party links is at your own risk and subject to their terms.


8. Strict Confidentiality

All non-public information designated or understood to be confidential (“Confidential Information”) must be kept strictly confidential. Use it only to access or use the Site as permitted. Unauthorized disclosure entitles us to injunctive relief without bond.


9. Governing Law & Exclusive Dispute Resolution

9.1 Governing Law:
These T&C are governed by the laws of India, without regard to conflict-of-law rules.

9.2 Mandatory Arbitration:
All disputes arising from or relating to these T&C or your use of the Site shall be resolved by confidential, final, and binding arbitration in Gurugram, Haryana, under the Arbitration and Conciliation Act, 1996. The arbitrator’s award is final and enforceable in any court.

9.3 No Court or Class Actions:
You waive any right to litigate in court (except to enforce arbitration awards) and any right to a class, collective, or representative action.

9.4 Injunctive Relief:
Notwithstanding arbitration, we may seek immediate injunctive or equitable relief in the courts of Gurugram without posting bond for breaches of intellectual property or confidentiality.


10. Termination

We may, at our sole discretion and without notice, suspend or terminate your access to all or part of the Site for any reason, including breach of these T&C. Termination does not waive our right to pursue damages or equitable relief.


11. Severability & Survival

If any provision is held invalid or unenforceable, it shall be modified or severed to effect intent; the remainder remains in full force. Sections on Disclaimer, Liability, Indemnification, IP, Confidentiality, Dispute Resolution, Termination, and Survival survive termination.


12. Entire Agreement

These T&C (together with the Privacy Policy) constitute the entire agreement between you and Vigo Hiring regarding the Site and supersede all prior agreements, understandings, or representations.
